The fee schedule was developed on behalf of
the Montana Employment Relations Division through a
contract with Optum. Because the fee schedule includes data that is
proprietary to Optum, certain restrictions apply. These restrictions are set
out below.

LICENSE & RESTRICTIONS. Optum grants to User a nonexclusive,
nontransferable license to use the Optum data contained on this site (“the
Data”) only for purposes of determining the appropriate fee to charge or pay
for health care services provided pursuant to the Montana workers’
compensation system. User may not sublicense, assign, or transfer the license
or the Data to any third party. User may NOT use the Data on any public
computer based medical information system, or publish, translate, decompile,
disassemble, or create any derivative work based on the Data.
User understands that the Data are intended to be a fee schedule and not a
stated or implied “reasonable and customary” charge. The Data is provided
as-is. Optum PROVIDES THE DATA WITHOUT WARRANTY OF ANY KIND, AND DISCLAIMS
ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE
IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
DATA PROTECTION. United States and international copyright laws protect
this Data, accompanying documentation and file contents. User acknowledges that
the Data and the process and technologies included therein are valuable assets,
trade secrets, and/or copyrighted material of Optum and that Optum retains
title to the Data.
